The Supreme Court rejects the Swedish Armed Forces’ appeal in the case concerning PFAS contamination at Ärna Airport. The decision means that the authority must pay SEK 37 million (€3.4 million) in damages to Uppsala Vatten.
It was about six years ago that Uppsala Vatten sued the Swedish Armed Forces, after it was considered that the authority had contaminated soil and groundwater around the Ärna area with PFAS. The contamination is said to have occurred at Ärna Airport, where the Swedish Armed Forces used fire-fighting foam containing the controversial substance.
In 2021, the Swedish Armed Forces was cleared of liability by the Environmental and Land Court at Nacka District Court, a decision that Uppsala Vatten appealed. Last year, the ruling was overturned, and the agency was deemed responsible for the PFAS contamination, but the Swedish Armed Forces chose to appeal the decision.
Now, the Supreme Court has decided not to grant a trial, meaning the verdict stands, and the Swedish Armed Forces is required to pay SEK 37 million (€3.4 million) in compensation to Uppsala Vatten.
– Our hope is that we can cooperate with the Swedish Armed Forces on water-related issues and future costs for PFAS remediation. It is the responsibility of the Swedish Armed Forces to clean up the PFAS contamination, and we are ready to contribute with our expertise. Our hope is that the remediation work will begin soon, and that we can reach an agreement with the Swedish Armed Forces on how future costs will be handled, without prolonged legal proceedings, says Tomas Ulväng, CEO of Uppsala Vatten, in a press release.
Used toxic firefighting foam in Kallinge
In Kallinge, the Swedish Armed Forces have also been in trouble with the water company. After having used fire extinguishing foam containing PFAS that was then spread into the water for several decades.
Residents in the area, who drank the water for several years, sued the municipally owned Ronneby Miljöteknik after it was found that they had elevated levels of the chemicals in their blood.
After several rounds, the residents of Kallinge were granted compensation after the Supreme Court determined that the elevated levels might lead to negative health effects. Despite the Swedish Armed Forces being held responsible for these PFAS contaminations as well, they will not pay out compensation, prompting Ronneby Miljöteknik to consider legal action against the agency.
Facts: PFAS
PFAS stands for Per- and polyfluoroalkyl substances and is sometimes also called highly fluorinated substances. It is an umbrella term for a large and complex group of more than 10,000 identified substances with varying properties and wide use in society. Common to all PFAS substances is that they are very difficult to break down and some PFAS can have harmful effects, both for humans and the environment. All PFAS substances are synthetically produced and do not occur naturally in the environment.
