Two COVID-19 vaccine-related lawsuits filed by Children’s Health Defense, the organization founded by Robert F. Kennedy Jr, have been rejected by the Supreme Court.
In one case, the organization challenged the US FDA’s emergency approval of covid-19 vaccines in December 2020. The lawsuit was filed with five parents in Texas and specifically challenged the approval of the covid-19 vaccines for children and their “ineffectiveness and lack of adequate review”.
The other lawsuit was filed together with 13 students against Rutgers University in New Jersey in 2021, challenging the covid vaccine requirement for students and arguing that it violates the US Constitution.
In the Texas case, the lawsuit was found to have no legal merit, reports NBC News. In the other case, the court concluded that the plaintiffs had “have not stated any plausible claim for relief”.
Robert F. Kennedy Jr, who ran for president, is president and general counsel of Children’s Health Defense and was also listed as one of the attorneys pushing the appeal in the Rutgers case. The organization is known to be critical of the covid-19 vaccines, but does not describe itself as anti-vaccine in general. It does, however, believe that vaccines should be properly tested and that people should never be forced to take a vaccine.
The organization has an ongoing lawsuit against a number of news organizations, including the Associated Press, accusing them of violating antitrust laws by, among other things, spreading disinformation about covid-19 vaccines.
